By accessing our website and placing an order with Elma Flowers, you agree to the following terms and conditions.
1. General
Elma Flowers provides floral arrangements and delivery services. All products are subject to availability and may vary slightly from images due to seasonality and the natural variation of flowers.
2. Orders & Payments
All orders must be paid in full at the time of purchase unless otherwise arranged. We offer cash on delivery where organised prior, either by phone or selected as a payment option when placing an order online.
We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or product unavailability.
3. Product Substitution
All arrangements are florist’s choice. Flower selections will vary, with arrangements differing slightly from images. Flower types and varieties may change based on seasonal availability, while maintaining the overall style and quality.
4. Delivery
- Customers are responsible for providing accurate delivery details.
- We are not liable for failed or delayed deliveries due to incorrect or incomplete information.
- If the recipient is unavailable, flowers may be left in a safe location at the driver’s discretion or redelivery may incur an additional fee.
- Delivery timeframes are estimates and not guaranteed.
5. Perishable Goods
Flowers are perishable items and require proper care. Elma Flowers is not responsible for deterioration due to environmental conditions, incorrect handling, or failure to follow care instructions after delivery.
6. Refunds & Returns
Due to the perishable nature of our products, we do not offer refunds for change of mind.
However, in accordance with Australian Consumer Law, if your order is faulty, damaged, or not as described, please contact us within 24 hours of delivery with photographic evidence. We will assess the issue and may offer a replacement or refund where appropriate.
7. Cancellations & Changes
Orders may only be cancelled or modified with sufficient notice prior to dispatch. We cannot guarantee changes or cancellations once an order has been prepared or is out for delivery.
8. Liability
To the extent permitted by law, Elma Flowers is not liable for any indirect or consequential loss arising from the use of our products or services. Our liability is limited to the value of the goods purchased.
9. Intellectual Property
All content on our website, including images, branding, and text, is the property of Elma Flowers and may not be used without permission.
10. Privacy
We respect your privacy and handle personal information in accordance with applicable Australian privacy laws.
